These Terms of Service ("Terms") govern your use of the RackData mobile application and website at rackdata.io (collectively, the "Service") operated by RackData LLC ("RackData," "we," "us," or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you are 13 or older and have the legal capacity to enter into these Terms. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
Account Registration
To access certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@rackdata.io if you suspect unauthorized access to your account.
You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
Subscription Plans and Billing
RackData offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually as selected at signup. All iOS subscriptions are managed through the Apple App Store and are subject to Apple's billing terms.
- ●Free plan: Available at no charge with limited features as described on rackdata.io/pricing.
- ●Scout, Hunter, and Land Manager plans: Billed in advance on a recurring basis. Prices are listed on rackdata.io/pricing and may be updated with 30 days notice.
- ●Hibernate mode: A reduced-rate plan ($4.99/mo) that preserves your data during the off-season. Reactivate to your previous tier at any time.
- ●Annual subscriptions: Billed once per year at a discounted rate. No refunds for partial years unless required by applicable law.
- ●Cancellation: You may cancel at any time through the App Store subscription settings or rackdata.io/account. Your plan remains active until the end of the current billing period.
iOS subscriptions are billed through Apple and managed via RevenueCat. Web subscriptions are handled by Stripe. We do not store your payment card information.
HerdMind AI and AI-Generated Analysis
HerdMind is RackData's artificial intelligence engine that analyzes trail cam photos, classifies deer sightings, and generates property-specific stand recommendations via RackScore. You acknowledge and agree that:
- ●HerdMind results are provided for informational and decision-support purposes only and are not guaranteed to be accurate.
- ●AI analysis accuracy improves as more sighting data is added to your property profile. Early results with limited data will be less reliable.
- ●RackScore stand grades are recommendations based on your historical data and current conditions — not guarantees of deer activity.
- ●You should not rely solely on HerdMind or RackScore for critical hunting or wildlife management decisions.
- ●Photos submitted for analysis are processed by Google's Gemini API under Google's applicable terms and privacy policies.
RackLog and User-Submitted Data
RackLog allows you to manually log hunt sightings and observations. Data entered via RackLog is treated as sighting data and feeds into HerdMind the same way trail cam photos do. You are responsible for the accuracy of data you enter. RackData is not liable for recommendations generated from inaccurate user-submitted data.
User Content
You retain ownership of all photos, data, and content you submit to the Service ("User Content"). By submitting User Content, you grant RackData a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing the Service to you.
You agree not to submit User Content that:
- ●Violates any law or regulation
- ●Infringes any third party's intellectual property rights
- ●Contains malware, viruses, or malicious code
- ●Depicts illegal hunting activities or wildlife violations
We reserve the right to remove User Content that violates these Terms or that we determine is harmful to the Service or other users.
Acceptable Use
You agree not to:
- ●Use the Service for any unlawful purpose
- ●Attempt to reverse engineer, decompile, or extract the source code of the app
- ●Use automated scripts or bots to access the Service
- ●Attempt to gain unauthorized access to our systems or other users' accounts
- ●Resell or sublicense access to the Service
- ●Use the Service in a way that could disable, overburden, or impair it
Intellectual Property
The Service, including all software, text, graphics, logos, HerdMind AI technology, RackScore, and RackLog, is owned by RackData LLC and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. RackData, HerdMind, RackScore, and RackLog are trademarks of RackData LLC.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT HERDMIND OR RACKSCORE RESULTS WILL BE ACCURATE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACKDATA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify and hold harmless RackData LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.
Termination
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time by contacting support@rackdata.io. Termination does not entitle you to a refund of prepaid subscription fees except where required by law.
Governing Law
These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Louisiana.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and on rackdata.io. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
